These Terms of Service govern your use of ItemLogue. Please read them before using the app.
1. Agreement to these Terms
By downloading, accessing, or using the ItemLogue mobile application (“ItemLogue”, the “app”) you agree to these Terms of Service. If you do not agree, do not use the app. ItemLogue is operated by 31 North Horizon LLC (the “Company”, “we”, “us”).
2. Who can use ItemLogue
You must be at least 18 years old, or the age of majority where you live, and able to enter a binding contract. ItemLogue is a tool for tracking resale and personal inventory and is intended for that purpose.
3. Your account
You sign in through a supported provider — Google, Apple, or email and password. You are responsible for keeping your credentials secure and for activity under your account. Provide accurate information and keep it current. Tell us promptly at [email protected] if you believe your account has been accessed without permission.
4. Subscriptions, billing, and AI scanning
ItemLogue offers a free plan and paid plans. Paid subscriptions are sold and billed through the Apple App Store or Google Play, under their terms — not directly by the Company.
- Subscriptions renew automatically for the same period unless cancelled at least 24 hours before the current period ends.
- Manage or cancel a subscription in your App Store or Google Play account settings. Deleting the app does not cancel a subscription.
- The free plan includes a monthly allowance of AI scans, used when ItemLogue reads a receipt or haul photo; the allowance refreshes monthly and unused scans do not roll over. Paid plans remove this limit for normal reselling use, subject to fair-usage limits on automated or very high-volume scanning. All other features are unmetered.
- Prices may change; you will be notified as required by the app store. Continued use after a change means you accept it.
- Except where required by law or store policy, payments are non-refundable. Refund requests are handled by the app store.
If you are a consumer in the European Union, the United Kingdom, or another jurisdiction with mandatory consumer-protection rights, nothing in these Terms removes rights you cannot waive — including any statutory right to cancel or withdraw from a purchase. Because subscriptions are sold by the app stores, cancellations, withdrawals, and refunds are processed through Apple or Google under their policies and applicable law.
5. Acceptable use
You agree not to:
- use ItemLogue for any unlawful purpose;
- upload content you have no right to upload;
- attempt to disrupt, reverse engineer, or gain unauthorized access to the service;
- circumvent, overload, or abuse usage limits, scan allowances, or rate limits, or access the service through automated or scripted means; or
- use the app to infringe anyone’s rights.
We may suspend or end access that violates these Terms.
6. Your content and data
You keep ownership of the data you put into ItemLogue — receipts, photos, item details, sales records, tags, and notes (“Your Content”). You grant the Company a limited license to store, process, and display Your Content solely to operate the service for you, including sending receipt and haul images to our recognition providers to extract item details (see the Privacy Policy). You can export your data as CSV at any time and delete your account from Settings.
7. AI-assisted features
ItemLogue uses automated text and image recognition to read receipts and haul photos. This is a best-effort convenience and can make mistakes — always review extracted information before saving. ItemLogue is a record-keeping tool. It does not provide financial, accounting, tax, or other professional advice, and you are responsible for the accuracy of your records and for any decisions you make using them.
8. Intellectual property
ItemLogue — including its software, design, branding, and the ItemLogue name and logo — is owned by the Company and protected by law. These Terms do not grant you rights to our intellectual property beyond using the app as intended.
9. Third-party services
ItemLogue works alongside third-party services — including the Apple App Store and Google Play, your chosen sign-in provider, and the providers that power the app (Supabase for cloud database and storage, Google Cloud for text and image recognition, RevenueCat for subscription management, and Apple and Google for push notifications). Your use of those services is governed by their own terms and privacy policies. The Company is not responsible for third-party services.
10. Availability and “as is”
We work to keep ItemLogue available and reliable, but we do not guarantee uninterrupted or error-free service. To the fullest extent permitted by law, ItemLogue is provided “as is” and “as available”, without warranties of any kind.
11. Changes to the service, limits, and plans
ItemLogue evolves. We may add, change, limit, or remove features, plans, storage allowances, scan allowances, rate limits, and other usage limits at any time. Some of these limits reflect the cost of the third-party services ItemLogue depends on — including cloud, storage, and AI-recognition providers. If those costs or terms change, we may adjust limits, the contents of a plan, or pricing accordingly.
Where a change would materially reduce a paid feature you are actively using, we will give reasonable advance notice and, where the app store requires it, obtain your consent. We may also suspend or discontinue the service, or any part of it, at our discretion.
12. Limitation of liability
To the fullest extent permitted by law, the Company is not liable for any indirect, incidental, or consequential damages, or for any loss of data, profit, or revenue, arising from your use of — or inability to use — ItemLogue. Where liability cannot be excluded, it is limited to the amount you paid to use the app in the 12 months before the claim. Nothing in these Terms limits liability that cannot be limited under applicable law, including the mandatory consumer rights described in Section 4.
13. Suspension, termination, and account deletion
You can stop using ItemLogue at any time and delete your account from Settings. On deletion, your account is marked deleted and access ends; data is retained only as described in the Privacy Policy.
We may suspend, restrict, or terminate your access — immediately and without notice where we consider it necessary — if we reasonably believe you have breached these Terms, used ItemLogue unlawfully or abusively, attempted to harm or overload the service or other users, or created security or legal risk for anyone. To the extent permitted by law, we may also decline to provide, or to continue providing, the service to any person.
14. Changes to these Terms
We may update these Terms from time to time. Material changes will be notified in the app or by other reasonable means. The “Last updated” date above shows the current version. Continued use after changes take effect means you accept the updated Terms.
15. Governing law
These Terms are governed by the laws of the State of New Jersey, United States, without regard to its conflict-of-laws rules, and you and the Company submit to the exclusive jurisdiction of the state and federal courts located in New Jersey — except where mandatory local consumer law gives you the right to bring proceedings in, or have your rights governed by the law of, the place where you live.
